What role does a Customs Agent play?
The Customs Agent is an auxiliary professional of the customs public function, whose license enables him before the Customs to provide services to third parties as manager in the clearance of goods. The Customs Agent may provide their services to any Customs in the country.
In what situations do I need the services of a Customs Agent?
In imports, when they exceed US $ 1,000.- FOB and in exports when they exceed US $ 2,000.- FOB.
What is FOB value and CIF value?
FOB – Free on board (named port of loading). The seller makes the delivery when the merchandise passes the ship’s rail at the agreed port of shipment. This means that the buyer has to bear all the costs and risks of loss or damage to the merchandise from that moment on. The FOB term requires the seller to clear the merchandise through customs for export.
CIF – Cost, Insurance and Freight (Cost, insurance and freight; named port of destination). The seller makes the delivery when the merchandise passes the ship’s rail at the agreed port of shipment. The seller must pay the costs and freight necessary to bring the merchandise to the named port of destination, but the risk of loss or damage to the merchandise, as well as any additional costs due to events occurring after the time of delivery, are transferred from the seller to buyer. However, under CIF conditions, the seller must also procure maritime insurance for the buyer’s risks due to loss or damage of the merchandise during transport. The CIF term requires the seller to dispatch the merchandise for export.
What types of goods can be covered by Chile's Free Trade Agreements?
All the goods that are negotiated in the agreement. Some treaties require that the merchandise be new only.
What goods can be imported?
Any merchandise can be imported, except those that are expressly prohibited by current legislation, such as, for example: used motorcycles, used motor vehicles (except for legal exceptions), asbestos in any of its forms, pornography, toxic industrial waste, among others. .
On occasions, the product to be imported, by its nature, may be subject to approval, authorization or control by some inspection service, so it is necessary to obtain it, in advance, from the respective body.
What merchandise require visas, certifications or good bills for importation?
All those merchandise that, in accordance with current legislation, must be subject to control prior to importation, by a State agency. By way of example, the following are mentioned: Products Alcohols, alcoholic beverages and vinegars of animal or vegetable origin are endorsed by the Agricultural and Livestock Service (www.sag.gob.cl). What should I do to import a merchandise?
Depending on the value of the merchandise, the import process has two systems:
a)If the value of the merchandise does not exceed US $ 1,000 FOB value: the procedure can be done personally by the importer before the respective Customs, in a simplified way. In this case, the importer must present the following documents:
- Original bill of lading or document that takes its place, depending on the transport route.
- Commercial invoice.
- Power of attorney of the owner or consignee for a specific office, in cases in which the person processing is a third party.
- Good Views or Certifications when applicable
b)If the value of the merchandise exceeds US $ 1,000 FOB value: the importer must hire a customs agent. In the event that the clearance of the merchandise must be entrusted to this professional, the importer must deliver the basic documents required to prepare the Declaration of Entry, which may be submitted to the Customs Service, via the internet.
Regarding the basic documents, it is necessary to specify that there are some that are mandatory for all imports of a commercial nature, and other documents that are required only on certain occasions. Among the mandatory documents for all imports of a commercial nature are the following:
- Original bill of lading, bill of lading or air waybill, proving ownership of the merchandise by the consignee.
- Original commercial invoice, which certifies the merchandise object of sale and its values.
- Sworn declaration of the importer on the price of the goods, form delivered by the customs agent.
- Mandate constituted by the only endorsement of the original bill of lading.
Among the documents that are required only for certain import operations are the following:
- Certificate of Origin, in case the import benefits from a tariff preference, under a Trade Agreement.
- Packing list, where applicable, always corresponding in the case of goods packed in containers.
- Insurance certificate, when the value of the premium is not consigned in the commercial invoice.
- Expense Note, when these are not included in the commercial invoice.
- Permits, visas, certifications or approvals, when applicable
What is certification of origin?
Document issued and / or endorsed by the chambers of commerce or other competent bodies of the exporting country, which serves to prove that the merchandise consigned originates from the nation mentioned therein. It is usually required for tariff reasons, since there are countries that have discriminatory rates depending on the country of origin.
What goods can be exported?
In general, all types of merchandise can be exported, with the exception of those prohibited by law.
